Medically Necessary Treatment in the School Setting

A private health-care specialist may be permitted to come onto the premises of any District school for the purpose of providing medically necessary treatment to a student if it has been determined by the student’s IEP team or 504 team that such medically necessary treatment must be provided to the student within the school setting pursuant to section 504 of the federal  Rehabilitation Act of 1973”, 29 U.S.C. sec. 794, as amended, and Title II of the federal “Americans with Disabilities Act of 1990.”

The provision of medically necessary treatment to students by private health-care specialists must be done in accordance with this policy. If medically necessary treatment requires administration of prescription and/or nonprescription medications to students, such administration must be in accordance with applicable law and the Board's policy concerning the administration of medications to students.

Medically Necessary Treatment in School Setting

Authorizing Private Health-Care Specialists to Provide Medically

School Teams will follow the following process when a request for medically necessary treatment is made in the school setting. This process is aligned with the Board’s policy and regulation. 

  1. Parents initiate the process by submitting a request to the building principal. If other staff receive a request from parents, the request should be forwarded to the building principal.  
  2. Parents must submit the health-care provider’s prescription for treatment to occur during the school day, a signed HIPAA-release for the District to speak with the prescribing health-care provider and health-care specialists implementing the treatment, and proof of insurance funding the services. For Medicaid, evidence that the treatment has been approved to be administered during the school day and at school is required. 
  3. The building principal will notify the 504 and/or IEP team members of the request. After all documentation has been received from the parents, the case manager will schedule a meeting with the appropriate IEP team or 504 team members, including the parents. The health-care provider or specialist may be invited by parents to the 504 or IEP meeting. 
  4. The 504 and/or IEP team members, including a special education administrator, a similar school-related provider (i.e., SLP, BCBA, RBT, etc.), and building administrator will meet with the parents and the health-care provider or specialist.

Morgan County Medically Necessary Process 

If the team agrees to permit the medically necessary services in the school setting, the Parents, Health-Care Specialist, and District will execute the Health-Care Specialist Agreement.
